Lose fork in the box ended up in scratches. To date, no resolution

Bought a new bike frame, paid for the shipping insurance. Packing was poorly done, most likely by Specialized. Want to return the bike, but to date answers are vague and I am still more than $5000 out of pocket and a frame I do not want (bought another one in the meantime)
